1. Purpose of This Agreement
This Buyer–Seller Agreement establishes the general terms and responsibilities that apply to transactions between buyers and sellers using the AntiqList marketplace.
Its purpose is to clarify the relationship between:
the buyer;
the seller; and
AntiqList as the online marketplace platform.
2. AntiqList as a Marketplace Platform
AntiqList provides an online platform that may allow users to:
create listings;
discover items;
communicate with other users;
negotiate transactions;
use available payment services;
arrange shipping; and
access related marketplace services.
Unless expressly stated otherwise, AntiqList is not the seller or buyer in transactions between users.
3. Buyer–Seller Contract
Unless otherwise expressly stated, when a buyer purchases an item from a seller, the resulting sales agreement is between the buyer and seller.
The buyer and seller are responsible for understanding and fulfilling the obligations created by their transaction.
4. No General Agency Relationship
Use of AntiqList does not automatically create an agency, partnership, employment, franchise, fiduciary, joint venture, or other representative relationship between AntiqList and a buyer or seller.
A seller does not have authority to bind AntiqList unless AntiqList has expressly granted such authority in writing.
5. Acceptance of a Transaction
A transaction may become binding between a buyer and seller when the parties have reached an agreement in accordance with applicable law and the terms communicated between them.
Depending on the transaction, acceptance may occur through:
an accepted offer;
a completed purchase;
an accepted proposal;
a confirmed payment; or
another mutually agreed method.
6. Listing Information
Sellers are responsible for ensuring that listing information is accurate and not misleading.
This includes, where applicable:
title;
description;
price;
age;
origin;
authenticity;
provenance;
condition;
dimensions;
materials;
photographs;
restoration;
ownership information; and
legal status.
7. Seller Representations
By offering an item for sale, the seller represents, to the extent applicable, that:
the seller has the legal right to sell the item;
the listing is accurate;
material defects have not been intentionally concealed;
authenticity claims are made honestly;
provenance claims are not knowingly fabricated;
required permissions are obtained where necessary; and
the transaction complies with applicable law.
8. Buyer Responsibility
Before purchasing, the buyer should reasonably evaluate:
the item;
the seller;
the listing;
photographs;
authenticity claims;
provenance;
condition;
shipping arrangements;
payment method;
applicable taxes; and
relevant legal restrictions.
9. Price
The seller is responsible for establishing the advertised price unless the platform expressly provides a different pricing mechanism.
The buyer is responsible for reviewing the total amount payable before completing a transaction.
10. Additional Charges
The total cost of a transaction may include charges beyond the listed item price, including where applicable:
shipping;
insurance;
taxes;
customs duties;
import charges;
payment-provider fees; or
other applicable charges.
The parties should clarify responsibility for such charges before completing the transaction.

confirmed authenticity;
attribution;
estimated age;
uncertain attribution;
reproduction;
replica;

Depending on the item, this may include:

repairs;
restoration;
replacement parts;
repainting;
refinishing;
missing components;
structural damage;
alterations; and
other material defects.

Sellers should avoid intentionally manipulating photographs in a way that conceals material defects or creates a false impression of authenticity, condition, age, or quality.
15. Reproductions and Replicas
Modern reproductions and replicas must be clearly identified.
A modern reproduction must not be presented as an original antique, historical object, or genuine period piece.
The Modern Reproductions & Replica Policy applies in addition to this Agreement.

stolen property;
unlawfully obtained property;
disputed property without appropriate disclosure;
property belonging to another person without authority; or
property subject to legal restrictions that prevent the sale.

A seller should independently confirm that payment has been successfully completed before releasing an item.
A screenshot or message claiming that payment was made should not be treated as sufficient confirmation where payment-system confirmation is available.

Users should be particularly cautious of requests for:
passwords;
authentication codes;
full card information;
unusual payment methods;

AntiqList may take platform measures where appropriate, including:
