Intellectual Property / Copyright Policy

AntiqList – Intellectual Property / Copyright Policy
Last Updated: 07 September 2026
Version: 1

Legal Name: AntiqList
Address: Yenişafak Mah. Merkezefendi Denizli / Türkiye
Email: [email protected]
Website: https://www.antiqlist.com/

1. Purpose of This Policy
This Intellectual Property / Copyright Policy explains how intellectual property rights are treated on the AntiqList platform and how AntiqList responds to reports of copyright, trademark, and other intellectual property infringement.

AntiqList respects the intellectual property rights of creators, artists, photographers, authors, brands, sellers, rights holders, and other parties.

Users of AntiqList are responsible for ensuring that the content they upload, publish, display, transmit, or otherwise make available through the platform does not unlawfully infringe the rights of others.

This Policy forms part of the AntiqList Terms of Use and other applicable marketplace policies.

2. What Is Intellectual Property?
Intellectual property may include, depending on applicable law:

Copyrights;
Trademarks and service marks;
Trade names and logos;
Photographs and images;
Written works and descriptions;
Artwork and creative works;
Catalogs and publications;
Designs;
Illustrations;
Videos and audiovisual works;
Software and databases;
Certain trade secrets and confidential information;
Other legally protected intellectual property rights.

Different types of intellectual property may be subject to different legal protections and procedures.

3. Copyright
Copyright may protect original creative works, including photographs, written descriptions, articles, illustrations, artwork, videos, graphics, catalogs, and other original materials.

Users must not upload, reproduce, copy, distribute, display, or otherwise use copyrighted material belonging to another person or organization without appropriate authorization or a valid legal basis.

Examples of potentially infringing activity include:

Uploading another person's photograph without permission;
Copying another website's product descriptions;
Reproducing copyrighted catalog text;
Using copyrighted artwork in a listing without authorization;
Copying photographs from auction houses, museums, galleries, dealers, or other websites;
Uploading scans or reproductions of copyrighted publications without appropriate rights.

The fact that material is publicly available on the internet does not automatically mean that it is free to copy or reuse.

4. User-Uploaded Content
Users may upload content to AntiqList, including:

Photographs;
Listing descriptions;
Videos;
Documents;
Item information;
Logos or branding;
Provenance information;
Other materials relating to a listing.

By uploading or submitting content, the user represents that they have the necessary rights, permissions, licenses, or other lawful authority to provide that content to AntiqList and to make it available through the platform.

Users remain responsible for the legality of the content they submit.

5. Rights in User Content
Unless otherwise agreed in writing, users retain ownership of intellectual property rights they lawfully own in their original content.

However, by submitting content to AntiqList, the user grants AntiqList a non-exclusive, worldwide, royalty-free license, to the extent legally permitted, to host, store, reproduce, format, display, distribute, communicate, adapt, and otherwise use that content as reasonably necessary to:

Operate the AntiqList platform;
Display listings;
Provide marketplace services;
Promote listings and the platform;
Improve platform functionality;
Create technical copies and backups;
Moderate and review content;
Prevent fraud and abuse;
Comply with legal obligations.

This license continues for as long as reasonably necessary for these purposes, including where copies remain in technical backups or records maintained for legitimate operational or legal reasons.

AntiqList does not acquire ownership of a user's intellectual property merely because the user uploads it.

6. Permission to Upload Content
Before uploading content, users should ensure that they have the necessary rights to use it.

A user must not upload content if doing so would:

Infringe another person's copyright;
Infringe another person's trademark;
Violate a license or contractual restriction;
Misappropriate protected creative material;
Violate confidentiality obligations;
Violate applicable law.

Where content belongs to another person, organization, photographer, artist, publisher, auction house, dealer, or rights holder, the user should obtain appropriate permission before using it.

7. Photographs Used in Listings
Photographs are particularly important in an antiques marketplace.

A user who uploads a photograph to AntiqList is responsible for ensuring that they have the necessary rights to use and publish the photograph.

Users should preferably use:

Their own photographs;
Photographs they have been authorized to use;
Photographs provided under an appropriate license;
Public-domain photographs where the applicable legal requirements are satisfied.

Users should not simply copy photographs from:

Other marketplaces;
Auction websites;
Museum websites;
Gallery websites;
Dealer websites;
Social media;
Catalogs;
Search engines;
Other online sources.

A photograph showing an item does not necessarily belong to the owner of the physical item.

Ownership of a physical antique and copyright ownership of a photograph depicting that antique are separate matters.

8. Listing Descriptions and Written Content
Users must create or lawfully obtain the descriptions they publish on AntiqList.

Users should not copy substantial portions of another website's:

Product descriptions;
Auction descriptions;
Catalog entries;
Articles;
Research material;
Dealer descriptions;
Editorial content.

Users may provide factual information about an item, but the wording used to express those facts may itself be protected by copyright depending on the circumstances.

9. Trademarks and Brand Names
Trademarks, service marks, logos, trade names, and other brand identifiers may belong to their respective owners.

Users must not use trademarks in a manner that falsely suggests:

Sponsorship by the trademark owner;
Endorsement by the trademark owner;
Authorization by the trademark owner;
Affiliation with the trademark owner;
Authenticity where no such relationship exists.

Using a brand name to accurately identify an item may be lawful in some circumstances. However, users remain responsible for ensuring that their particular use does not violate applicable trademark or unfair competition laws.

10. Counterfeit and Unauthorized Branded Items
AntiqList prohibits listings involving counterfeit or unauthorized branded products where prohibited by applicable law or AntiqList policy.

This may include:

Counterfeit designer goods;
Fake branded watches;
Unauthorized reproductions of branded products;
Fake certificates or labels;
Products falsely represented as being manufactured by a particular brand.

Such listings may be removed and the associated account may be restricted or suspended.

11. AntiqList's Own Intellectual Property
The AntiqList name, branding, logos, website design, platform software, graphics, interface elements, original text, databases, and other materials created or controlled by AntiqList may be protected by intellectual property laws.

Except where expressly permitted, users may not:

Copy AntiqList's website design;
Reproduce AntiqList branding;
Use AntiqList logos without authorization;
Scrape or systematically reproduce protected platform content;
Reproduce substantial portions of AntiqList's databases;
Reverse engineer protected platform components where prohibited by law;
Create a misleadingly similar service or brand using AntiqList's protected materials.

Nothing in this Policy transfers AntiqList's intellectual property rights to users.

12. Third-Party Intellectual Property
AntiqList may display or link to content, brands, trademarks, images, services, or other materials belonging to third parties.

Such materials remain the property of their respective owners unless otherwise stated.

The presence of third-party intellectual property on AntiqList does not necessarily mean that AntiqList owns, sponsors, endorses, or is affiliated with the relevant rights holder.

13. Intellectual Property Complaints
If you believe that content available through AntiqList infringes your intellectual property rights, you may contact us at:

Email: [email protected]

A complaint should provide enough information for AntiqList to understand and investigate the alleged infringement.

Where reasonably possible, include:

Your full name or the name of the rights holder;
Contact information;
Identification of the intellectual property right allegedly infringed;
A description of the protected work;
The URL or specific location of the allegedly infringing content;
A description of why the content is allegedly infringing;
Evidence supporting your ownership or authorization to act on behalf of the rights holder;
Any other information reasonably necessary to evaluate the complaint.

Providing complete and accurate information can help us review a complaint more efficiently.

14. Authority to Submit a Complaint
If a complaint is submitted on behalf of another person or organization, the complainant should have appropriate authority to act on behalf of the relevant rights holder.

AntiqList may request additional information or documentation where reasonably necessary to verify the complaint or the complainant's authority.

15. Review of Intellectual Property Complaints
After receiving a sufficiently detailed complaint, AntiqList may review the reported content.

Depending on the circumstances, AntiqList may:

Request additional information;
Contact the uploader;
Temporarily restrict access to content;
Remove or disable access to content;
Restrict a listing;
Suspend an account;
Terminate an account;
Request proof of authorization;
Preserve relevant records where appropriate;
Take other measures permitted by applicable law and platform policies.

AntiqList does not guarantee that every complaint will result in removal.

16. Content Removal
Where AntiqList determines that content appears to infringe intellectual property rights, violates applicable law, or violates platform rules, AntiqList may remove or restrict the content.

AntiqList may also take action where content creates a significant legal, fraud, safety, or reputational risk.

Removal of content does not necessarily constitute a legal determination that infringement occurred.

17. Notice-and-Takedown Procedures
AntiqList may operate a notice-and-takedown process for intellectual property complaints.

The exact legal procedure may vary depending on:

The country involved;
The type of intellectual property right;
The location of the rights holder;
The location of the user;
The applicable law;
The nature of the content;
Whether a specific statutory notice procedure applies.

Where a specific statutory procedure applies, AntiqList may process the complaint in accordance with the requirements of that applicable law.

18. DMCA Notices
The United States Digital Millennium Copyright Act (“DMCA”) provides specific procedures for certain copyright complaints involving services operating in the United States.

If a legally applicable DMCA procedure applies to a particular AntiqList service or activity, AntiqList may process qualifying notices in accordance with applicable requirements.

This Policy does not represent that the DMCA governs every AntiqList user, listing, transaction, or complaint worldwide.

Rights holders should provide sufficient information to allow AntiqList to determine which legal procedure, if any, applies.

19. Counter-Notifications and Responses
If content is removed following an intellectual property complaint, the affected user may contact AntiqList and provide information explaining why they believe the removal was incorrect.

Depending on the applicable law and circumstances, AntiqList may provide an appropriate opportunity to respond or challenge the removal.

A response may include:

Identification of the affected content;
An explanation of the user's rights;
Evidence of authorization;
A license or permission;
Evidence that the material is original;
Evidence that the material is in the public domain;
Other relevant legal or factual information.

AntiqList may request additional information before restoring content.

20. Repeat Infringement
AntiqList may take stronger enforcement measures against users who repeatedly upload content that is found to infringe intellectual property rights.

Depending on the circumstances, measures may include:

Removal of individual listings;
Listing restrictions;
Account warnings;
Temporary suspension;
Permanent account termination;
Restrictions on future registrations;
Other measures permitted by applicable law.

AntiqList may consider the seriousness, frequency, circumstances, and available evidence when taking enforcement action.

21. False or Abusive Complaints
Intellectual property complaint procedures must not be used to:

Harass users;
Unfairly suppress lawful competition;
Remove legitimate listings without a valid basis;
Misrepresent ownership;
Submit fraudulent claims;
Abuse AntiqList's reporting systems.

Knowingly submitting materially false information may result in rejection of the complaint and may lead to appropriate action.

Nothing in this section prevents a person from making a good-faith complaint where they reasonably believe their rights have been infringed.

22. Public-Domain and Licensed Material
Some works may be in the public domain or available under licenses that permit particular forms of use.

Users remain responsible for determining whether the material they upload may lawfully be used in the manner intended.

A work being old does not automatically mean that every associated photograph, reproduction, restoration image, catalog entry, or modern description is in the public domain.

23. Antique Objects and Copyright
The age of an antique object does not necessarily determine the copyright status of photographs or written material associated with it.

For example:

An antique painting may be old enough that copyright in the original work has expired;
A modern photograph of that painting may have separate copyright protection;
A modern catalog description may have separate copyright protection;
A museum's digital image may be subject to separate rights or contractual restrictions.

Users should therefore distinguish between the intellectual property rights in an underlying historical object and rights in modern reproductions or documentation.

24. User Responsibility for Intellectual Property
Each user is responsible for ensuring that their activities on AntiqList comply with applicable intellectual property laws.

This includes responsibility for:

Listing photographs;
Listing descriptions;
Logos;
Documents;
Videos;
Product images;
Uploaded certificates;
Marketing material;
Other uploaded content.

AntiqList does not automatically verify ownership or licensing rights for every piece of user-submitted content.

25. AntiqList's Role
AntiqList operates as an online marketplace/classified platform that allows users to publish and discover listings.

Unless expressly stated otherwise, AntiqList is not the owner or creator of user-submitted content.

AntiqList does not guarantee that every item, photograph, description, trademark, or document uploaded by users is free from third-party intellectual property claims.

However, AntiqList may review reported content and take action where appropriate.

26. No Transfer of Ownership
Uploading content to AntiqList does not transfer ownership of intellectual property to AntiqList.

Similarly, purchasing or owning a physical antique does not automatically transfer copyright or other intellectual property rights associated with that object.

Users should obtain appropriate rights or permissions separately where necessary.

27. Legal Requests and Cooperation
AntiqList may cooperate with valid legal requests from courts, regulators, law enforcement agencies, rights holders, or other authorized parties where required or permitted by applicable law.

AntiqList may preserve or disclose information where legally required or reasonably necessary to:

Protect users;
Protect the platform;
Investigate suspected infringement;
Prevent fraud;
Comply with legal obligations;
Respond to lawful proceedings.

Any disclosure will be handled in accordance with applicable law and AntiqList's Privacy Policy.

28. International Intellectual Property Rights
Intellectual property laws differ between countries.

Content that is lawful in one jurisdiction may be restricted in another.

Because AntiqList may be accessible internationally, users are responsible for complying with applicable laws relating to their content and activities.

Where a specific legal requirement applies to a particular jurisdiction, AntiqList may take appropriate measures consistent with that requirement.
