1. Purpose of This Policy
This Taxes & Customs Policy explains the general responsibilities of buyers and sellers concerning taxes, customs duties, import and export requirements, customs declarations, and other governmental charges associated with transactions conducted through AntiqList.

Because AntiqList operates primarily as an online marketplace connecting buyers and sellers, the parties to a transaction are generally responsible for determining and complying with the tax and customs obligations applicable to their transaction.

This Policy does not constitute tax, customs, legal, accounting, or professional advice.

2. Scope
This Policy applies to transactions involving:

domestic purchases;
international purchases;
imports;
exports;
antique and collectible items;
artwork and historical objects;
cultural property;
professional and business sellers;
individual sellers; and
buyers purchasing for personal or commercial purposes.

Different laws may apply depending on the countries involved, the nature of the item, its value, origin, age, classification, and the status of the buyer and seller.

3. AntiqList's Role
AntiqList generally acts as a marketplace platform and does not ordinarily act as:

the buyer;
the seller;
the importer of record;
the exporter of record;
a customs broker;
a tax adviser;
an accountant;
a freight forwarder; or
a customs authority.

Unless expressly stated otherwise, AntiqList does not determine the tax or customs treatment of individual transactions.

4. Buyer Tax Responsibilities
Buyers are responsible for understanding and complying with taxes and governmental charges that may apply to their purchases.

Depending on the transaction, buyers may be responsible for:

import VAT;
sales or use taxes;
customs duties;
customs processing fees;
brokerage charges;
handling fees;
local taxes; or
other governmental charges.

Mandatory legal requirements prevail over any private agreement between buyer and seller.

5. Seller Tax Responsibilities
Sellers are responsible for complying with tax obligations arising from their sales.

Depending on their circumstances, sellers may be required to:

report income;
collect applicable taxes;
issue invoices;
maintain transaction records;
register for applicable tax systems;
account for VAT or sales taxes; or
comply with business reporting obligations.

Professional and business sellers may have additional obligations.

6. Individual Sellers and Professional Sellers
Tax treatment may differ depending on whether a seller is:

a private individual;
an occasional seller;
a professional dealer;
an antique business;
an incorporated company; or
another commercial entity.

Sellers are responsible for accurately representing their business status where required by law or AntiqList's platform requirements.

7. Tax Information in Listings
Where taxes are applicable or legally required to be disclosed, sellers should provide accurate information concerning:

item price;
applicable taxes;
shipping charges;
additional charges; and
any known import or export costs.

Sellers must not intentionally mislead buyers about the total cost of a transaction.

8. VAT and Similar Consumption Taxes
Depending on the jurisdiction and circumstances of a transaction, VAT, GST, sales tax, use tax, or similar consumption taxes may apply.

Whether such taxes apply may depend on:

buyer location;
seller location;
item location;
delivery destination;
seller status;
buyer status;
item classification;
transaction value; and
applicable law.

AntiqList does not guarantee a particular tax treatment.

9. Tax-Inclusive and Tax-Exclusive Prices
Where applicable, sellers should clearly indicate whether displayed prices include or exclude taxes.

Professional sellers may have additional legal obligations concerning price transparency.

Where mandatory consumer law requires prices to be displayed on a tax-inclusive basis, applicable requirements must be followed.

10. Customs Duties
International shipments may be subject to customs duties imposed by the destination country.

Customs duties may depend on factors such as:

declared value;
customs classification;
country of origin;
material;
age;
item type;
destination country; and
applicable tariff rules.

AntiqList does not determine or guarantee the amount of customs duties.

11. Import Taxes
An international purchase may be subject to import taxes in the destination country.

Such taxes may include:

import VAT;
GST;
sales tax;
use tax;
excise taxes; or
other legally applicable charges.

The buyer should verify applicable requirements before completing an international purchase.

12. Customs Processing and Brokerage Fees
Carriers, customs brokers, postal services, or other logistics providers may charge additional fees.

These may include:

customs clearance fees;
brokerage fees;
disbursement fees;
storage fees;
inspection fees; or
administrative charges.

These fees are generally separate from the purchase price unless expressly included.

13. Importer of Record
Depending on the jurisdiction and shipping arrangement, the buyer or another designated party may be treated as the importer of record.

The importer of record may be responsible for:

customs declarations;
duties;
taxes;
permits;
documentation; and
compliance with import laws.

Users should determine who holds this responsibility before shipment.

14. Exporter Responsibilities
Sellers shipping items internationally must comply with the export laws applicable to the country from which the item is being exported.

This may include obtaining:

export permits;
government approvals;
cultural property documentation;
wildlife permits;
certificates; or
other required authorizations.

15. Customs Declarations
Customs declarations must be accurate and complete.

Users must not intentionally:

undervalue an item;

misstate its age;
misstate its origin;
falsely describe an item as a gift;
omit required information; or
provide false documentation.

16. Undervaluation
Intentionally declaring an item at a value lower than its actual transaction value in order to reduce taxes or customs duties is prohibited.

Such conduct may expose the responsible party to:

customs penalties;
seizure;
additional duties;
fines;
investigation; or
other legal consequences.

17. False "Gift" Declarations
A commercial transaction must not be falsely declared as a personal gift for the purpose of avoiding taxes, duties, or customs requirements.

Sellers and buyers are responsible for ensuring that declarations accurately reflect the nature of the transaction.

18. Country of Origin
Where customs documentation requires the country of origin, users must provide accurate information.

Country of origin should not be fabricated or altered to obtain preferential customs treatment or avoid restrictions.

19. Item Classification
Items may need to be classified under applicable customs tariff or commodity classification systems.

Classification may depend on:

material;
function;
age;
composition;
intended use;
country of origin; and

historical documents; and
culturally significant objects.

Users must comply with all applicable cultural property laws and permit requirements.

International trade in such materials may be prohibited or subject to permits.

Users are responsible for verifying applicable wildlife and customs requirements before shipment.

25. Weapons and Military Objects
Historical weapons, firearms, ammunition, military equipment, and related objects may be subject to special import and export restrictions.

Where an item requires a license, permit, authorization, or specialized carrier, the responsible parties must obtain the necessary approvals.

Items prohibited under AntiqList's Prohibited & Restricted Items Policy may not be traded or shipped through the platform.

storage;
customs processing;
duties;
taxes;
brokerage charges; or
other applicable fees.

Responsibility depends on the circumstances, transaction terms, and applicable law.

Buyers and sellers should verify the requirements applicable to returned merchandise, temporary exports, refunds, or re-importation.

33. Temporary Imports and Exports
Some jurisdictions provide special procedures for temporary import or export of:

artwork;
antiques;
exhibitions;
collectibles;
museum objects; or
other cultural property.

Where such procedures apply, the responsible party must comply with all applicable requirements.

34. Customs Value
Customs authorities may determine or verify the customs value of an item according to applicable law.

The transaction price may not always be the final amount accepted by customs authorities.

AntiqList does not guarantee that a declared value will be accepted by customs.

Where legally required, sellers should provide appropriate invoices, receipts, or transaction records.

Documents should accurately reflect:

seller;
